It sounds like you are having a similar problem as most others are at the moment, try either downgrading your kernel to 2.6.32.15 or earlier or upgrading to 2.6.35-rc4 or newer to fix this.

well I did some more messing around and interestingly enough it works just fine with sudo and running it with root privileges. Somewhere there must be a permissions problem.
